Many problems typically encountered on a construction project can be avoided at the contract negotiation stage by careful attention to the details of the insurance and bonding issues, dispute resolution mechanisms, and clarification of the parties’ responsibilities with respect to performance and payment issues. Certain advantages can be obtained and many problems avoided by applying new statutory and case law developments to the contractual issues.
