As a partner in the firm's Construction & Surety Industry Practice Group, Mr. Ashbaugh concentrates his practice in construction and surety litigation, contract preparation and negotiation and alternate dispute resolution. He has been practicing law since 1977. Prior to that he spent eleven years as an Army Engineer in the Corps of Engineers. Mr. Ashbaugh has successfully defended and prosecuted cases on behalf of contractors, architects, engineers, bonding companies, and public and private owners. His construction claims experience includes payment bonds, mechanics' liens, delays, disruption, extra work, professional negligence, construction defects, indemnity, lost profits and property damage cases. He has also defended blasting damage and dam operation/flood claims. In addition to construction litigation, Mr. Ashbaugh has litigated patent, trademark and copyright infringement cases and counsels individuals and companies on patent, trademark and copyright matters.
Mr. Ashbaugh is a member of the Neutrals Construction Panel of the American Arbitration Association, the Panel of Arbitrators of the National Arbitration Forum, the Panel of Arbitrators for the Construction Arbitration Service at the Allegheny County Bar Association, and the American and Allegheny County Bar Associations. He is a registered professional engineer in Colorado and Virginia. Mr. Ashbaugh is a member of the Society of American Military Engineers where he has been elected to the grade of Fellow. He is also a member of the American Society of Civil Engineers. Since 2006, Mr. Ashbaugh has been named a PA Super Lawyer for Construction Litigation, a designation that is awarded to the top five percent of lawyers practicing in Pennsylvania.
Mr. Ashbaugh received his B.S. from the United States Military Academy at West Point, his M.S. in Civil Engineering from the University of Missouri-Rolla and his J.D. from the University of Denver. Mr. Ashbaugh is admitted to practice before the state and federal courts in Pennsylvania, the United States Court of Appeals for the Federal Circuit, the United States Supreme Court, and the United States Patent and Trademark Office.
